Möglichkeit und Reichweite der Übertragbarkeit zivilrechtlicher Ansätze auf die strafrechtliche Produkthaftung

There are repeated cases of consumers being injured by defective products. Extensive concretisations have already been made in case law and literature for civil product liability. Criminal product liability, on the other hand, lags behind. This study examines the question of whether (possibility) and to what extent (scope) civil law approaches can be transferred to criminal product liability. After a general comparison between criminal law and tort law, the study addresses the question of the uniformity of manufacturer duties with regard to product liability, as well as the differences and similarities in the determination of causality.
