Nachhaltigkeit durch Verbandspartizipation

Sustainability issues have enormous political and social implications. Intergenerational justice issues have been in focus not only since the groundbreaking climate decision of the Federal Constitutional Court on 24 March 2021. The author examines how new procedural and action rights for sustainability protection associations can be used to implement the state mandate of sustainability from Article 20a of the German Constitution more effectively. The central model is the extension of environmental association participation to sustainability interests. The work presents a new understanding of sustainability as "de-temporalized environmental protection" and offers an objective legal safeguard for the rights of future generations through the proposed institutionalization of sustainability protection remedies.
