Nationale Gerichte im Klimaschutzvölkerrecht

Climate change litigation challenges our understanding of the role of domestic courts in international law. This book compares four climate change cases and examines the role of domestic courts under the 2015 Paris Agreement. Domestic courts take a hinge function in the bottom up approach of the international climate change regime: They link domestic climate change provisions to the Paris Agreement’s long-term temperature goal. As courts are embedded into diverse legal and extra legal contexts on the national level, they do not always decide in favour of climate protection measures. However, a comparative view of climate change litigation reveals that domestic courts put international and national law into a procedural relationship.
