Description
This study provides a comparative analysis of renegotiation duties in cases of hardship and offers new guidance for scholarship and legal practice in contract law. It examines the prerequisites, scope, limits and legal consequences of such duties.
Taking § 313 BGB as its point of departure within an international context, the work compares in particular French and Italian law, selected Asian legal systems and international model rules such as the PICC, PECL and DCFR. Methodologically, it combines doctrinal analysis with comparative law and draws extensively on case law and scholarship.
The book is addressed to scholars and practitioners of contract law. The author completed her doctorate at Ludwig Maximilian University of Munich.
