Open justice and confidentiality are among the key parameters in selecting international dispute resolution mechanisms. This study undertakes a systematic comparative legal analysis of the individual factors and examines in which jurisdiction they are realised most effectively. It contrasts arbitration law, which is valued for its confidentiality, with International Commercial Courts, having been established worldwide since the early 21st century. These hybrid institutions, positioned between state courts and arbitral tribunals, are assessed for their potential to serve as a competitive alternative to arbitration.
