Many groups operate in a matrix organsation. The group companies are connected in function- and product-related business units which are managed across the group by so called matrix managers.

In her dissertation the author examines whether the specific characteristics of the matrix organisation require a reinterpretation of the definition of a plant in the sense of the German Works Constitution Act. Based on a systematic analysis of the organising principles of the works constitution and the legal concept of the matrix organisation in a group of companies the author points out that the solution for the identified problems may be found in the legal principles of representation. The organisational units of the matrix organisation are to be recognized only in exceptional cases as virtual „matrix plants“ in addition to the conventional plants of the group companies. Based on these conclusions the author analyses the employees‘ and matrix managers‘ staff membership in a plant.
