Orientalisches Eherecht vor deutschen Gerichten – Kompatibilität und Konfliktpotenzial

In light of the migration movement, German courts are increasingly confronted with legal institutions that have their roots in foreign legal systems and cultures. Especially in the area of marriage and family law, the differences in legal, social and value systems are clearly reflected.
This work shows that the examination of legal institutions and standards of judgment from oriental legal systems is of great importance within German legal practice. An interim balance is drawn up in which, on the one hand, the handling of foreign legal institutions by the German courts is analyzed and, on the other hand, the limits of their applicability within the framework of our legal system are shown and practice-oriented suggestions for action/measures are presented.
