Persönlichkeitsrechte im Sportarbeitsverhältnis

The author analyses the application of national employment law in sports. Specifically the legal relationship between athletes, coaches and referees on the one hand and sports associations and clubs on the other hand are considered in detail. The main focus is on employment law and its task of protecting personality rights. The following three topics are extensively described: The right of being employed and the possibility to transfer athletes to a lower unit, the treatment of medical data through the employer as well as rights and duties as regards to commercial marketing.
Common issues in sports practice are solved in accordance to national employment law. Furthermore general principles for the entire employment law in sports are derived from the results and illustrated related to practice. In this context the thesis is also intended for sports associations, clubs and athletes.
The author works as a lawyer and advises on the whole area of employment law.
