This dissertation provides legal practitioners with a comprehensive presentation of the key legal issues in connection with personal data breaches. The work combines academic depth with practical solutions and is therefore intended in particular for legal advisors, companies, data protection officers and supervisory authorities dealing with data breaches.
The main focus lies on the interfaces between Union and national law. The term “data breach” as well as the notification and disclosure obligations of Art. 33 f. GDPR are examined. The work also deals with the administrative, criminal and civil law consequences of data breaches, including the legal issues relevant in practice in connection with criminal law prohibitions on the use of evidence and civil law claims for damages.
