Pragmatische Stadtentwicklung nach § 34 Baugesetzbuch?

The regulation of § 34 BauGB is of great practical importance in urban development and, in particular, in the field of redensification. In contrast to the ‘Bebauungsplan’ [development plan], no complex planning and participation procedures are envisaged here, as the (further) urban development takes place within the framework of the bound application of the law. Contrary to what can be expected from a theoretical perspective, however, in the context of § 34 BauGB, municipal planning interests and citizen participation can also become decisive factors. The regulation of § 34 BauGB as a suitable instrument for pragmatic urban development?
Eight empirical case studies on individual construction projects and redensification processes enable a scientific discussion between theoretical claim and practical reality. The present work is based on an interdisciplinary research approach with a focus on building law and planning theory.
