Claims of discrimination frequently fail due to lack of evidence, even though Sec. 22 of the German General Equal Treatment Act (AGG) significantly eases the standard and burden of proof. Ambrosi therefore examines the judicial practice in anti-discrimination lawsuits through empirical case studies and conducts a comprehensive legal-theoretical analysis which concludes: Section 22 AGG is designed to address information asymmetries. Building on the findings of the analysis, Ambrosi develops practical guidelines and questionnaires for courts and practicioners.
