Pricing algorithms and artificial intelligence are increasingly being used in digital markets. What impact does this development have on competition? Can a collusive behavior of pricing algorithms be adequately covered by current antitrust law? And if not, how should this issue be regulated in the future?
The author addresses these questions and presents an innovative regulatory proposal to close existing protection gaps: The integration of pricing algorithms into the AI Act. By including AI systems for price setting in the AI Act, the risks of collusion could be reduced in advance and behaviour that violates antitrust law could be detected subsequently.
