Privates Datenschutzrecht im Lichte der Grundrechte

Does data protection law strike an appropriate balance between the protection of personal data, respect for private life, freedom to conduct a business and other interests? The example of the processing of motor vehicle data, such as for assistance systems, service files or the development of autonomous driving, highlights the problems of the abstract and technology-neutral provisions of the GDPR. Based on the fundamental rights concerned, which serve as guidelines for interpretation, this study develops concrete proposals for solutions to questions such as identifiability, legitimate interests and conditionality. From a legal policy perspective, however, sector-specific (new) regulations would be preferable.
