The scholarship relating to Art. 14 German Grundgesetz focuses traditionally on public law issues. The relevance of the constitutional right to property on private law has been mostly neglected in academic research. The volume sheds light on this issue by analysing the impact of Art. 14 Grundgesetz on relationships among individuals or private entities.
The contributions illustrate the convergences and discrepancies of the concept of property in public and private law from a historical perspective. Furthermore, the essays examine the impact of the constitutional right to property on private law by analysing examples taken from the law concerning the respective interests of neighbours, tenancy law, residential property law and insolvency law. The examples focus on the question of how Art. 14 Grundgesetz affects legal issues and disputes in private law contexts.
