This dissertation identifies competitive digital gaming as the determining characteristics of the eSports entity, qualifies professional eSports as an activity protected by constitutional freedom of occupation, classifies individual players as employees under Sec. 611a para. 1 sentence 1 of the German Civil Code, and deems processing of disciplinary information for talent acquisition under Art. 6 para. 1 subpara. 1 lit. b) and f) of the European General Data Protection Regulation permissible. Methodologically, the dissertation combines scientific theory, philosophy of language, and legal doctrine.
