In our information society, the importance of capital market information is steadily increasing and thus, requires a fundamental systematisation of the relevant liability provisions. In this context, the relationship between codified prospectus liability and prospectus liability developed further by judicial decisions plays a prominent role. The findings gained in the context of this analysis are also useful with regard to liability for capital market information published in other forms, whose existence and substantive foundations have been disputed.
