In the wake of the diesel scandal and the trucks cartel, mass litigation by financed debt collection service providers have gained massively in importance. In this context, it is repeatedly criticised that there are conflicts of interest between the service provider, the funder and the claimant. In a comparative legal analysis and taking into account the principal-agent theory of behavioural economics, the author outlines the development of third-party litigation funding, the current state of regulation and its necessity. It is shown why there is still a need for legislative action in Germany even after the RDG reform has come into force and to what extent the regulation in England and Australia can serve as a model for this.
