Menschenrechte im Strafrecht
Description
Instead of being uniform procedural regulations, the criminal proceedings of the European Public Prosecutor's Office are structurally based on the reciprocal bilateral or multilateral integration of procedural rights of the participating member states under the umbrella function of the EPPO Regulation. Using the example of transnational evidence proceedings, the work outlines this procedural pluralism and examines its advantages and disadvantages. The author examines whether the interplay, interlocking, and coexistence of widely differing procedural rights is suitable for fulfilling the ambitious premises of the prosecution authority. Based on numerous weaknesses and areas for development, individual suggestions for improvement are made to achieve the objectives.
