After Maastricht the European Union has become more than an Economic Community - it aims at a far reaching protection of the economic, ecological, social and political rights of its citizens. Implementation of these rights depends on access to law and to courts – not only Community but also national jurisdictions. Improved judicial protection is one of the most important points on the Maastricht II-agenda.
The book contains contributions of 24 leading specialists on Community law. They examine the complex structures of European judicial protection. Part I is devoted to fundamental issues of access to law before Community jurisdictions, including a paper by the former Advocate General of the European Court of Justice Van Gerven proposing a reorientation of tort law. Part II is devoted to protection of economic interests, part III to public interest litigation in protecting citizen"s rights. In Part IV the former ECJ judge Zuleeg evaluates perspectives of public interests litigation before European courts, thereby proposing an amendment of Art. 173 EC-Treaty.
