There is a multitude of different regulations for official information on products at European level. Against the background of the Europe-wide product safety network, this work examines the rapid alert information system RAPEX in the European administrative network.
In a detailed analysis, the tension between the fundamental rights of economic operators and fundamental rights of the recipients of information is addressed. In particular, problems in the handling of RAPEX are critically examined and it is shown that restrictions of entrepreneurial freedom cannot be justified per se. Furthermore, the paper points out deficits in legal protection that have to be closed de lege ferenda.
The author is a lawyer and advises domestic and foreign companies on product compliance.
