The book analyses the guidelines provided by the constitution for regulating assisted suicide and derives from them a concrete framework within which a legislative protection concept for those wishing to die must operate. After the Federal Constitutional Court declared Section 217 of the Criminal Code unconstitutional, the debate on this issue is once again in full swing in politics and academia. But how much paternalism does the constitution allow? And why should responsible citizens be protected from themselves in the first place? To get to the bottom of this, the author also examines the legal-philosophical foundations of the Basic Law and develops legal criteria for state paternalism in the case of assisted suicide.
