How should contracting authorities determine the most economically advantageous tender? This thesis provides an interdisciplinary framework for more lawful and expedient decisions regarding the award evaluation system. Among other things, it redefines the scope of the ex ante transparency obligation since the CJEU's Dimarso ruling (C-6/15) and defines the 'weighting' of award criteria using microeconomic theory. Governance deficits are empirically substantiated: contracting authorities regularly make lawful yet economically suboptimal decisions. To address this, the evaluation methods commonly used in Germany are systematised and assessed from an interdisciplinary perspective. The thesis identifies ways to minimise these governance deficits. The author is a public procurement lawyer in Hamburg.
