Rechtliche Grundlagen der Zugänglichkeit geologischer Daten

Geological data, especially such derived by drilling, is subject to the INSPIRE-Directive as well as to the directive on public access to environmental information, even though there was no recognizable intent to cover them. The accessibility of geological data is of great importance for the extraction of raw materials.

The book answers the question under which conditions geological data, in particular so called exploration data, can be published in general or can be released on application. Furthermore, it deals with several structural aspects of freedom of information: it reflects on the temporal protection of commercial and industrial information, challenges the lawfulness of granting copyright under the reservation of a balancing-test, illuminates the relation between free access to information and legal cooperation and considers what requirements are necessary to determine persons who may be affected by a publication of data.
