Rechtsextremismus in der Justiz?

This thesis analyses the tension between judicial independence and constitutional loyalty at the constitutional and statutory levels considering increasing extremist tendencies. It shows that judges, due to their far-reaching decision-making powers, must meet special requirements for constitutional loyalty that set them apart from other civil servants. Emphasis is placed on the historical efforts to combat extremism, and current deficiencies in selection, supervision, and sanction mechanisms are highlighted. The thesis concludes with possible reform options that ensure a balance between judicial independence and constitutional loyalty, demonstrating that these two principles do not need to be contradictory.
