Rechtsrahmen zur Regulierung der Wasserstoffnetze

How can regulation be utilised as a market-constitutive catalyst? In the hydrogen sector, the need for regulation arises not only from the emergence of the internal market but also from the objective of decarbonising the energy system. Grounded in regulatory theory, this study deduces economically sound indicators for the sector-specific governance of natural monopolies. The analysis of the regulatory triad – access, tariffs, and unbundling – is guided by competition law determinants and, building upon Directive (EU) 2024/1788, develops innovative concepts for steering the market ramp-up de lege ferenda. Consequently, this work provides legislators, regulatory authorities, and practitioners with an essential framework for the energy transition.
