This book reconstructs the emergence of European jurisprudence in the twelfth century as a process of social differentiation and then traces the evolving process of differentiation between the law and legal studies in early modern and modern law.
This differentiation, whose important aspects were the claims of early modern political actors to determine the law by means of legislation, the practice of early modern lawyers to describe the law as the product of legal learning, and modern constitutions and the idea of constitutional jurisdiction, was expressed in the 19th century through the concept of validity (Geltung).
