The Act on the Promotion of Mediation and Other Extrajudicial Conflict Resolution Procedures fails to achieve the goal that gave it its name. To remedy the conceptual deficiencies of the current law, Christoph Weber designs a comprehensive, coherent and at the same time moderate regulatory concept for the adequate promotion of mediation.
To this end, Christoph Weber differentiates between indirect, in particular cost-associated options of promotion on the one hand and direct promotion through mediation on the other, whereby the existing provisions of the ZPO and the FamFG are used as references. The regulatory model developed on this basis is moulded into a well thought-out draft law that can be adopted in full if the legislator sets out to promote mediation effectively.
