Regulierungszuständigkeiten in der Telekommunikation

The European and German telecommunications law has undergone a dynamic change, as the markets of this sector have. The abolition of the telecommunications monopolies is accompanied by an European sector-specific regulation, which should establish competition in this sector. These sector-specific rules overlap with the general competition law. The consequence is a nontransparent framework consisting of rules of German general and sector-specific competition and constitutional law, European telecommunications and competition law and international law. This coincides with confusing regulatory competences.
The purpose of this book is to examine the regulatory competences in the telecommunications markets, in particular the jurisdiction of the new Regulatory Authority for Telecommunications and Post (Regulierungsbehörde für Telekommunikation und Post) and to evaluate the existing institutional solution, taking diverse reform proposals into account.
