This study is the first to explore, from a comparative legal perspective, the procedural constraints on judicial sentencing discretion in China and Germany. Drawing on a functionalist comparative methodology, the author examines how procedural norms in both jurisdictions serve three core functions: enhancing the transparency of sentencing decisions, enabling effective participation of parties in the sentencing process, and ensuring structural oversight by the court system. The research provides a novel contribution to comparative criminal justice studies by offering new insights into the interaction between procedural safeguards and judicial discretion in sentencing.
