Description
This dissertation aims to rethink the current licensing of patents in order to enable the exploitation of the large number of granted but currently unused patents.
Thus, it shows the deficits of the seemingly attractive but rarely used license of right under Section 23 of the German Patent Act, whose original goal of simplifying and reducing the costs of patent exploitation is currently being missed.
In comparison to Chinese and British law, it formulates target-oriented legal amendments that could enable the general public to use patented inventions during the twenty-year patent term in return for appropriate remuneration determined by the German Patent and Trade Mark Office.
