Russia - an "unsecure" third country? Given the absence of an “adequacy decision” issued by the European Commission, Russia is currently regarded from a European perspective as an "unsecure" third country. As a consequence, personal data from the European Union can only be transferred to Russia with additional safeguards. This may appear surprising, given that Russia has adopted a data protection law that has many parallels to the former EU Data Protection Directive. Against this background, the thesis examines which criteria decide on the adequacy of the level of data protection, analyses the legal situation in Russia, including existing case law and local authority practices, and presents possible approaches to enhance the level of personal data protection in Russia.
