Description
The German legislator introduced with the 10th amendment to the ARC Sec. 19a ARC. Companies with paramount significance for competition across markets can justify their behavior on the merits of the case at hand in proceedings pursuant to Sec. 19a(2) ARC. They carry the burden of proof in this regard. The author analyses why the German legislator decided to allow companies to justify their behavior. The European legislator decided not to allow gatekeepers to justify their behavior in DMA proceedings, although the goal of the DMA is comparable. The author also analyses the reasons companies can invoke in order to justify their behavior and the admissibility and limits of the burden of proof placed on the companies.
