In recent years, an increased number of striking abuse proceedings have been initiated (for example against Google). At the same time, tort law has gained importance as another pillar of antitrust enforcement. So far, damages actions focus on compensation for damages caused by cartel agreements.
The author examines and evaluates the provisions on antitrust damages as one of the first from the perspective of the violation of the prohibition of abusive practices. She focuses on the questions of entitlement to compensation and on the determination of the individual damage caused by the violation of the prohibition of abusive practices and its proof.
