This dissertation investigates the complex substantive questions regarding law and conflict of laws arising in the context of both vessel and wreck salvage on the high seas. Covering four legal systems, it aims to fill an academic void in the extant literature.
The first part of the dissertation focuses on the salvage of vessels in the absence of contractual agreements. Reviewing existing international law, the author highlights several areas that currently lack authoritative provisions. He evaluates the approaches of the chosen legal systems to these open questions and to determining applicable law.
Set against the background of increasing treasure hunting activities in the world seas, the second part of the dissertation deals with wreck salvage. Focusing on objects of archaeological and commercial interest, the author examines (non-)existing legal provisions in both national and international law. He concludes by proposing a solution in order to reconcile national heritage protection and commercial utilisation.
