What security interests justify preventing foreign investors from acquiring companies that possess key enabling technologies? Has European Regulation 2019/452 on the control of foreign direct investment shifted the line between security interests and economic considerations? The study addresses this question and also examines which limits are imposed by higher-ranking law. In order to determine the task of investment control, export law and competition law are taken into consideration as well. The work contains proposals for optimizing the current regulations and in this context also discusses whether the European Commission could take over the enforcement of controls.
