For the first time, this work deals in detail with the requirements of Section 4 (1a) FinDAG, which is important for supervisory practice. The work not only outlines the regulatory objective in the first sentence of the provision, but also examines the facts and legal consequences of the power to intervene in the second and third sentences in detail and comprehensively. The analysis is based on an examination of the relationship between public law and private law, which dissects the relationship between the two areas of law, particularly in the area of consumer law enforcement. Finally, proposals for amendments to Section 4 (1a) FinDAG are formulated on the basis of the findings.
