Schutzpflichtverletzungen

The thesis examines fundamental legal principles, which particularly concern the prerequisites of liability similar to contract and the protective obligations within a particular relationship under German law. The author brings together and further develops the existing principles of protective obligations in a meaningful way by focusing on the trilateral relationship of the parties involved in linked contracts. Based on the understanding of civil law as a legal assignment order, the author specifies this doctrine with elements of legal spheres and enriches the long-standing discussion with new elements.
