Description
The legally compliant, practicable and fair use of health data for research purposes is a key challenge for (health) data protection law. The further processing of data generated daily in clinical care offers enormous potential for medical research. At the same time, it is essential to protect the right of data subjects to informational self-determination, otherwise there is a risk of creating a scenario of transparent patients. This study provides a critical assessment of the complex regulatory landscape of health data protection law, examines possible solutions at European and national level, and shows a viable path between research interests and data sovereignty.
