Modern international criminal law has been subject to accusations of selectivity since its inception. Double standards, victor's justice, the law of the strongest – these are the accusations. This study assumes that the application of international criminal law has always been selective and is likely to remain so, which is not necessarily a shortcoming. Decisive are the criteria according to which the selection takes place. The theories of punishment are used as a foundation for the assessment of various selection strategies. After examining this elementary topic, the study addresses the question arising from the accusation of selectivity: Does the selectivity of international criminal law cause the loss of its legitimacy?
