Description
Does a preemptive state require solidarity from its citizens? Interventions in fundamental rights during the pre-threat phase are linked less to an individual’s behavior than to their affiliations. This leads to the thesis that such interventions increasingly activate the duty of those affected to make sacrifices for the common good and thus demand a higher degree of legal solidarity from them. Using selected individual measures from the field of preventive counterterrorism, this solidarity aspect can be identified and translated into criteria for how these measures can be designed to minimize infringements on fundamental rights. Furthermore, the author asks whether and how solidarity can be constitutionally mobilized to cope with crisis.
