Sorgfaltspflichten von Geschäftsleitern beim Einsatz Künstlicher Intelligenz in der Unternehmensführung

The remarkable advances in artificial intelligence (AI) are pushing for its use in the management of companies. For managers, however, the (non-)use of AI solutions can be associated with liability risks. This work sets out the legal framework for such use and examines the obligations for managers based on possible areas of application. Inter alia, the existing literature on delegation to employees and ISION case law are used as possible benchmarks and the effects on the business judgment rule are discussed.
