The desire of competitive athletes to recover quickly after an injury often stands in contrast to the medical obligation to prioritize low-risk treatment for patients. This creates a tension in terms of liability law, which is at the heart of the dissertation. A key example explored is the injection of analgesic substances, whose admissibility under medical liability law is closely examined. In addition, the dissertation investigates the legal standards that apply when assessing an athlete's fitness for competition. By doing so, the work offers valuable insights for both scientific and practical evaluation of the legal framework surrounding medical malpractice in the treatment of competitive athletes.
