Within the scope of a constitutional and criminal policy analysis the paper illuminates the new criminal offenses against betting fraud and match fixing which the German legislator established in reaction of match fixing scandals in recent years. It discusses whether the legislator is allowed to introduce criminal offenses in defense of the integrity in sport and whether these offenses are necessary in the face of existing general rules (§§ 263, 263a, 266 StGB). The paper also answers practical questions regarding the interpretation of the new offenses, for example whether the aspiring Esports are sport in terms of §§ 265c, 265d StGB.
