The book deals with the once a trader always a trader-principle in the context of the restrictive theory of state immunity, which guarantees, that once a state acts as participant on the market, it is obliged to hold on to the there applicable rules. Part of the book is not only the derivation of that principle, but also its scope. Therefore the author provides a new theory of distinction, which firstly identifies an imputable case and secondly determines on the basis of a imputability formula, if in the case in question the protection of the restrictive theory of state immunity shall be granted. In that context the book also covers the emission and restructuring of sovereign bonds.
