Staatliche Beteiligungen als Instrument der Krisenbewältigung – Ein Plädoyer für ein Krisenbeteiligungsrahmengesetz

Since the financial crisis 2008, the German government has increasingly invested in companies in existential crises to ensure their survival. The paper analyses corporate law aspects of the key stabilisation laws such as the Financial Market Stabilisation Act, the Economic Stabilisation Fund Act and the Energy Security Act. It shows the development of a standard procedure for rescue measures and argues in favour of a general crisis special company law. This should be based on the existing Economic Stabilisation Acceleration Act and serve as a legal framework for extraordinary crisis situations. The paper develops the key principles of a potential ‘crisis participation framework law’.
