The donor group for the living donation of organs that cannot be regenerated is severely limited in Germany due to § 8 paragraph 1 sentence 2 TPG. This work examines the restriction of the donor group and the criminal liability of those involved in the event of a violation of the restriction. In particular, the case group of "special personal connection" between donor and recipient is considered in the sense of § 8 paragraph 1 sentence 2 TPG. The work also looks at the cross-over donation and clarifies the question of whether a cross-over donation is permitted in Germany according to the current legal situation.
