Strafeinstellungen der Bevölkerung und ihre Bedeutung für den strafenden Staat

Does it matter what the population thinks about punishment and penalties in our legal system? This question is explored very fundamentally on the basis of the two potential addressees of such attitudes, legislation and the application of the law. Abstract and concrete gateways for so-called punitive attitudes within the existing legal system are worked out and at the same time the relationship between law and empiricism is addressed. In addition, the advantages and disadvantages of taking such punitive attitudes into account are discussed and initial considerations for an operationalization are made.
