What criteria should be used to allocate treatment places if the available resources are insufficient to treat all patients in need of treatment? This question, which has been the subject of much discussion during the Covid-19 pandemic, is the subject of this paper. After examining the possible risks of criminal liability for doctors in such a triage situation during the pandemic and identifying a need for legislative action, the author addresses the question of which criteria should be used for allocation and, for her part, submits a proposal for a legal regulation of the triage situation. She also looks at the newly introduced Section 5c IfSG.
