Strafrechtliche Auswirkungen des LkSG und der CSDDD

Neither the German Supply Chain Due Diligence Act (LkSG) nor the EU Supply Chain Act (CSDDD) contain criminal law provisions. However, the establishment of binding due diligence standards and monitoring obligations in the supply chain goes hand in hand with new due diligence and guarantee obligations, which inevitably also have an impact on the scope of criminal liability. The study examines the implications of the regulations on international corporate responsibility with regard to criminal liability of business owners and the significance of supply chain due diligence standards for negligence offences relating to the protection of life, limb and the environment.
