The individual corporate criminal liability of a manager of a group parent company may also relate to the prevention of group-related criminal offenses committed by employees of subsidiaries. The thesis examines the legal basis of the individual criminal liability of certain managers in a company and in a group of companies as well as from a comparative law perspective with US law. Whether a duty to prevent corporate crimes exists is to be determined from factual and control-related perspective. Furthermore, the limitation of the scope of the duty to prevent only company or group-related offenses and the possible addressees of the guarantor position in the individual company and group of company are discussed.
